Member Terms of Service

These Terms of Service ("Terms") govern your use of FitSynQ as a gym member. They apply when you use our member app, check in at a kiosk, or otherwise interact with our platform as an individual member of a gym that subscribes to FitSynQ.

If you operate or work for a gym, separate terms apply to your relationship with FitSynQ. These Member Terms only cover individual gym members.


1. What FitSynQ Is — and Isn't

FitSynQ is a software platform that gyms use to manage memberships, check-ins, classes, and payments. FitSynQ is not your gym. We do not own, operate, or supervise any physical fitness facility. We do not employ trainers, maintain equipment, set membership fees, or provide fitness advice.

Your relationship as a member is with your gym. Your gym sets its prices, schedules, policies, and rules. We provide the technology that helps your gym run. When you read "we," "us," or "FitSynQ" in these Terms, we mean the software platform — not your gym.

2. Eligibility

You must be at least 16 years old to create a FitSynQ member account. If you are under 18, your parent or guardian may need to give consent depending on your gym's policies and applicable Ghanaian law.

By using FitSynQ, you confirm that:

  • You are at least 16 years of age
  • You have legal capacity to enter into these Terms
  • The information you provide is accurate and complete
  • You will comply with these Terms, our Acceptable Use Policy, and applicable laws

3. Your Account

3.1 Account Creation

Your account may be created by you directly through the member app, or by your gym on your behalf. Either way, you are responsible for keeping your login credentials confidential and for everything that happens on your account.

3.2 Account Security

You agree to:

  • Maintain a strong, unique password
  • Not share your account credentials with anyone
  • Notify us promptly if you suspect unauthorised access at fitsynq@proton.me
  • Log out of shared devices after use

3.3 Accurate Information

Keep your profile information current — particularly your emergency contact and phone number. Out-of-date information can affect your gym's ability to reach you in emergencies and may limit your access to certain features (such as QR check-in, which requires a complete profile).

4. Your Relationship With Your Gym

4.1 Membership Terms Are Set by Your Gym

Your gym decides:

  • Membership fees and pricing
  • Class schedules and availability
  • Cancellation, refund, and freeze policies
  • Facility rules, dress codes, and conduct standards
  • Access hours and physical-safety protocols

If you have questions or complaints about any of these, contact your gym directly. FitSynQ cannot change your gym's policies for you.

4.2 Information Sharing With Your Gym

By using the member app or kiosk, your gym can see your profile information, check-in history, subscription status, class enrolments, and any sensitive data (such as exercise logs) you have consented to share. This is described in our Privacy Policy.

4.3 If You Change Gyms

If you leave your gym, your gym controls what happens to the data they hold about you. You may also ask us to delete your FitSynQ account — see section 11 and our Privacy Policy.

5. Payments

5.1 You Pay Your Gym, Not FitSynQ

When you pay a membership fee, class fee, or other charge through the member app, the payment is processed by Paystack and remitted to your gym. FitSynQ does not receive or hold your payment. We provide the technology; the money flows to the gym.

5.2 Refunds and Billing Disputes

All refunds, credits, partial charges, and billing disputes are decided by your gym, in line with the gym's own policies. We cannot issue refunds on behalf of a gym. If you believe you were charged in error, contact your gym first. If the dispute cannot be resolved with your gym, you may also raise the matter with Paystack or your bank.

5.3 Recurring Payments

If your gym offers recurring subscriptions, you can manage them in the member app — pause, change plan, or cancel — subject to your gym's terms. Cancelling a recurring payment does not automatically refund prior charges.

5.4 Payment Information

Payment-card details and mobile-money credentials are collected and stored by Paystack, not by FitSynQ. We see only transaction references and status. Paystack's terms and privacy policy apply to your use of their service.

6. Your Content

6.1 You Own What You Create

You own the content you put into FitSynQ — profile photos, workout notes, exercise logs, class ratings, feedback, and similar contributions ("Your Content").

6.2 Limited Operational License

So we can run the service for you, you grant FitSynQ a non-exclusive, royalty-free, worldwide licence to host, store, display, copy, and process Your Content solely as necessary to operate the platform and deliver the service to you and your gym. This licence ends when you delete Your Content or your account, except for backups and audit records we are required or permitted to retain (see our Privacy Policy).

6.3 What We Do Not Do With Your Content

We do not use Your Content for marketing, advertising, AI model training, or any purpose beyond running the service. We will ask for separate, explicit consent before any other use.

6.4 Responsibility for Your Content

You are responsible for what you post. You agree not to submit content that is illegal, defamatory, infringing, harassing, or otherwise prohibited by our Acceptable Use Policy. We may remove content that violates these Terms or the AUP.

6.5 Feedback

If you send us suggestions or ideas about FitSynQ (separate from Your Content), we may use them without compensation or attribution.

7. Acceptable Use

Your use of FitSynQ is also governed by our Acceptable Use Policy, which is incorporated into these Terms by reference. Please read it. Violations may result in suspension or termination of your account.

8. QR Codes and Check-In

The member app generates a QR code containing a short-lived secure token tied to your account. You use it to check in at gym kiosks. A few things to know:

  • Tokens expire automatically within 24 hours and a new one is issued the next time you open the member app while signed in. If your device is lost or stolen, existing tokens expire on their own; you do not need to contact us to revoke them.
  • Do not share your QR code with anyone else. Letting another person check in with your code may result in account suspension.
  • Your gym may require additional identification at check-in. Cooperate with reasonable verification requests.

9. Service Availability

We aim to keep FitSynQ available at all times, but we do not guarantee uninterrupted access. The service may be unavailable due to:

  • Scheduled maintenance (with advance notice when possible)
  • Unscheduled emergency repairs
  • Network or infrastructure issues outside our reasonable control
  • Force majeure events

We may modify, add, or discontinue features at any time. For material changes that affect how you use the service, we will give reasonable notice through the app or by email.

10. Disclaimers and Limitation of Liability

10.1 The Service Is Provided "As Is"

To the maximum extent permitted by Ghanaian law, FitSynQ is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

10.2 FitSynQ Is Not Responsible for Your Gym

FitSynQ is a software platform. We are not a fitness facility, fitness service provider, medical provider, or trainer. We are not responsible for, and disclaim any liability arising from:

  • Physical injury, illness, or death occurring at any gym
  • The condition, safety, or maintenance of gym equipment
  • The conduct, qualifications, or advice of trainers, staff, or other members
  • The accuracy or appropriateness of any fitness, nutritional, or health information shared through the platform
  • Theft, loss, or damage to your personal property at a gym
  • The cleanliness, security, or operating conditions of any gym facility

You acknowledge that exercise carries inherent risks and that you participate in physical activity at your own risk. Consult a qualified medical professional before beginning any new fitness programme.

10.3 No Liability for Member-to-Member or Member-to-Gym Disputes

Disputes between you and your gym, between you and other members, or between you and any third party are not our responsibility. We are not obliged to mediate, investigate, or take sides.

10.4 Limitation of Liability

To the maximum extent permitted by law, FitSynQ's total cumulative liability to you arising out of or related to these Terms or your use of the service shall not exceed GHS 500 (or its equivalent in your local currency). FitSynQ shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, or goodwill.

Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for fraud, gross negligence, or wilful misconduct.

11. Suspension and Termination

11.1 By You

You may close your FitSynQ account at any time from the member app or by emailing fitsynq@proton.me. Closing your FitSynQ account does not automatically cancel your gym membership — contact your gym separately if you wish to cancel that.

11.2 By Your Gym

Your gym may end your membership with the gym according to its own policies. This will remove your access to that gym's services through FitSynQ, but your underlying FitSynQ account remains and can be used if you join another FitSynQ gym.

11.3 By Us

We may suspend or terminate your FitSynQ account if you:

  • Materially breach these Terms or the Acceptable Use Policy
  • Engage in fraud, abuse, or illegal activity
  • Create a security risk for the platform or its users
  • Use the service in a way that could expose FitSynQ to legal liability

Where reasonable, we will give notice and an opportunity to remedy the breach before terminating. For serious violations, we may suspend or terminate immediately.

11.4 Effect of Termination

On termination, your right to use the service ends. Your data will be handled in accordance with our Privacy Policy — generally, identifying information is anonymised on deletion and hard-purged within 90 days. Sections of these Terms that by their nature should survive (including disclaimers, limitation of liability, governing law, and miscellaneous provisions) will continue to apply.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will:

  • Update the "Last updated" date
  • Surface a notice in the member app at next sign-in
  • Where appropriate, email registered members

If you continue using FitSynQ after a change takes effect, you accept the revised Terms. If you do not agree, you may close your account before the change takes effect.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ghana, without regard to conflict-of-laws principles.

If a dispute arises between you and FitSynQ:

  1. Talk to us first. Email fitsynq@proton.me with a clear description of the issue. We will engage in good-faith negotiation for at least 30 days.
  2. Courts of Ghana. If we cannot resolve the dispute through negotiation, it shall be submitted to the exclusive jurisdiction of the competent courts of Ghana.

You also retain any non-waivable rights you may have under applicable consumer-protection law.

14. Notices

We may send you notices by email, by in-app message, or by posting on this page. Notices to us should be sent to fitsynq@proton.me.

15. General Provisions

  • Entire Agreement. These Terms, the Acceptable Use Policy, and the Privacy Policy constitute the entire agreement between you and FitSynQ regarding the member-facing service.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
  • No Waiver. Failure to enforce any right is not a waiver of that right.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • No Agency. Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship between you and FitSynQ.
  • Headings. Section headings are for convenience only and do not affect interpretation.
