Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes what you can and cannot do on the FitSynQ platform. It applies to everyone who uses FitSynQ — gym operators, branch managers, staff, members, and any other user. Following this AUP is a condition of using the service.
1. Scope
This AUP forms part of the contract under which you use FitSynQ:
- If you are a gym member, the AUP is incorporated into the Member Terms of Service.
- If you are a gym operator (owner, manager, or staff), the AUP is incorporated into your subscription agreement with FitSynQ.
A breach of this AUP is a breach of those terms and may lead to suspension or termination of your access (see section 8).
2. General Conduct Expectations
When using FitSynQ, you agree to:
- Comply with all applicable laws and regulations
- Respect the rights, dignity, and privacy of other users
- Use the platform honestly and in good faith
- Provide accurate information about yourself or your business
- Cooperate with reasonable requests from FitSynQ to verify identity or investigate suspected misuse
3. Prohibited Activities
You must not, and must not attempt to, do any of the following:
3.1 Illegal or Harmful Use
- Use FitSynQ for any unlawful purpose, or in furtherance of any illegal activity
- Violate the privacy or rights of any individual, including by collecting or disclosing personal data without authorisation
- Engage in or facilitate harassment, hate speech, threats, stalking, or intimidation
- Promote violence, self-harm, or discrimination on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristic
- Engage in or facilitate human trafficking, exploitation, or any form of abuse
3.2 Fraud and Deception
- Impersonate any person or organisation, or misrepresent your affiliation with anyone
- Create accounts using false information, stolen identities, or another person's details without permission
- Engage in payment fraud, chargeback abuse, or any deceptive financial practice
- Allow another person to check in using your QR code, or check in using a QR code that is not yours
- Manipulate or falsify gym records, member counts, attendance, ratings, or analytics
3.3 Platform Abuse
- Send spam, unsolicited bulk messages, or commercial advertising through any FitSynQ channel
- Use FitSynQ to send phishing messages or distribute malware
- Interfere with, disrupt, or impose unreasonable load on the platform or its infrastructure
- Circumvent or attempt to circumvent rate limits, usage caps, or feature gates
- Use automated scripts, bots, scrapers, or crawlers without our prior written permission
- Reverse-engineer, decompile, or disassemble any part of the platform, except to the extent expressly permitted by law
3.4 Security Violations
- Attempt to gain unauthorised access to any account, system, network, or data
- Probe, scan, or test the vulnerability of any FitSynQ system without prior written authorisation
- Bypass, disable, or interfere with any security mechanism, including authentication, rate limiting, or content filtering
- Exploit a security vulnerability rather than reporting it (see section 7)
- Introduce malware, viruses, worms, trojans, or any other harmful code
- Use FitSynQ infrastructure to launch attacks against third parties
3.5 Content Violations
- Upload, post, or share content that is illegal, defamatory, obscene, pornographic, or otherwise objectionable
- Share content that infringes anyone's intellectual property, privacy, or publicity rights
- Share sensitive personal information about another person without their consent
- Upload content involving minors that is sexual, exploitative, or otherwise inappropriate — we report such content to relevant authorities
3.6 Commercial Misuse
- Resell, sublicense, or redistribute access to FitSynQ without our written consent
- Use FitSynQ to operate a competing service or to benchmark for the purpose of building a competing service
- Mine FitSynQ data for sale to third parties
- Use FitSynQ branding, logos, or names without permission
4. Gym Operator-Specific Rules
If you are a gym operator, in addition to the rules above, you must:
- Obtain valid consent from your members before entering their personal data into FitSynQ, including consent for any sensitive data such as health, fitness, or biometric information
- Honour your members' data rights (access, rectification, deletion, withdrawal of consent) in a timely manner
- Use member data only for legitimate gym operation purposes — not for unrelated marketing, sale to third parties, or other commercial exploitation
- Maintain reasonable security around staff accounts and admin-dashboard access
- Promptly remove access for staff who leave or change roles
- Cooperate with FitSynQ on data-protection matters, including responding to member complaints and assisting with regulatory inquiries
5. Member-Specific Rules
If you are a gym member, in addition to the rules above, you must:
- Keep your QR code private — do not share it with anyone else
- Follow your gym's facility rules, safety protocols, and conduct standards
- Provide accurate emergency contact information
- Use class ratings, feedback, and reviews honestly and in good faith
- Treat other members, gym staff, and FitSynQ support staff with respect
6. AI Assistant Use
The FitSynQ AI Assistant is available to authorised gym operators only. When using it, you must not:
- Attempt to manipulate the Assistant into bypassing tenant scoping or accessing data outside your gym's scope
- Use Assistant outputs as a substitute for professional medical, legal, or financial advice
- Submit prompts designed to generate harmful, illegal, or abusive content
- Probe the Assistant to extract training data, system prompts, or other internal information
AI-generated responses are informational only and may be inaccurate. You are responsible for verifying outputs before acting on them.
7. Reporting Violations and Vulnerabilities
7.1 Reporting Abuse
If you encounter conduct that violates this AUP, report it to fitsynq@proton.me with as much detail as possible — what happened, when, who was involved, and any supporting evidence. We treat reports confidentially where we can.
7.2 Reporting Security Vulnerabilities
If you discover a security vulnerability in FitSynQ, please report it to fitsynq@proton.me rather than exploiting or disclosing it publicly. We commit to acknowledging legitimate reports within a reasonable time and to working with you on responsible disclosure. We do not currently operate a paid bug-bounty programme, but we will credit researchers who report responsibly.
8. Enforcement
If we believe you have violated this AUP, we may take one or more of the following actions, at our discretion and proportionate to the severity of the violation:
- Issue a warning and request that the violating behaviour stop
- Remove specific content
- Restrict or limit specific features of your account
- Temporarily suspend your account while we investigate
- Permanently terminate your account
- For gym operators: suspend or terminate the entire organisation's access
- Report the violation to law-enforcement or regulatory authorities where appropriate
- Pursue civil or criminal remedies for serious violations, including those that cause harm to FitSynQ, our users, or third parties
We will normally give notice and an opportunity to respond before taking enforcement action, but for serious violations — including security threats, illegal content, or imminent harm — we may act immediately without prior notice.
9. No Obligation to Monitor
FitSynQ does not pre-screen or actively monitor user activity for AUP violations. We rely on reports from users, automated detection systems, and our own reasonable diligence. The absence of enforcement action in any specific instance does not constitute a waiver of our rights.
10. Changes to This Policy
We may update this AUP from time to time to reflect new abuse patterns, new features, or changes in applicable law. When we make material changes we will update the "Last updated" date and, where appropriate, notify users through the platform. Continued use of FitSynQ after a change takes effect constitutes acceptance of the revised AUP.
